Traffic Law

(Article One)

The following articles replace the texts of articles No. 7, 13, 35 bis (1), 66, 72 bis (2), 74, 74 bis, 74 bis (2), 76 of the traffic law issued by law No. 66 for the year 1973:

Article (7):

The motorcycle is a light means of transportation that moves by an automatic engine including the following types:

1-    Motorcycle with two wheels or more. A side or back box could be attached to it for carrying people and things.

2-    Tuk Tuk is a motorcycle with three wheels and is fitted to carry a number of passengers in return for a fare.

3-    Motorcycle with three wheels or more designed to move in rugged areas and is not allowed to move except in mountainous or coastal areas and is not allowed to carry passengers. A back box is allowed to be attached to it for carrying things.

All this is undertaken in accordance with the preconditions mentioned in the rules of this law and its rules and regulations.

Article (13):

Each vehicle while moving should carry two number plates that are handed out by the traffic department concerned after completing all license measures and paying out the insurance fees.

The rules and regulations of this law set the form of the number plate and data it includes along with signs of its insurance and its validity period and the places where it should be attached to the vehicle and the fees for upgrading the number plate that should not exceed 115 pounds and the value of its insurance that should not exceed 100 pounds.

The number plate is owned by the State and endorsed with its stamp. A license could not be granted without the number plate or when other plates are attached to the vehicle; otherwise the vehicle is seized for administrative violation.

The plate should always be identified easily with clear data that could be read at a distance.

One of the two plates should be attached to the front part of the vehicle and the other to the rear part of it in the place assigned for the number plates.

In the case of moving a truck or semi-trailer, only one number plate is required which is to be attached to the rear of the vehicle. In all cases no number plate is allowed to be attached in places other than those designed for it.

The metal plate should be locally made in a place where national security considerations are observed according to the regulations and preconditions set by the rules and regulations.

Article (35) bis (1):

In case the driver of a vehicle is proven committed any traffic accident that would lead to the death or injury of somebody, his driving license could be cancelled and he could not obtain another one except after passing a new training course that is not less than three months in one of the driving centers or schools that are accredited by the general authority for traffic so that he would obtain the same driving license of the same degree and after being re-examined in line with the same preconditions and tests mentioned in the text of article (35) and without violating the text of article (36).

Article (66):

Driving a vehicle is banned for anybody who is under the influence of alcohol or drugs.

The judicial arrest officers, in case of arrest while violating the first paragraph of this article in one of the cases mentioned in article (30) of the criminal procedures law, have the right to order examining the condition of the driver by the technical means that are set by the interior minister according to an agreement with the minister of health without violating measures that should be adopted in accordance with the law.

Article (72) bis (2):

Without violating any stricter punishment mentioned in any other law, any driver who would cause pollution to the street through throwing waste or any other thing of the likes, will be punished with a fine not less than 500 pounds and not more than 1,500 pounds. Also, the same punishment is applied to anybody who would drive a vehicle issuing disturbing noise or emitting heavy smoke or has an exhaust pipe that is not meeting the environmental preconditions, or emitting bad smell or has a piece or more of the cargo dropping from the vehicle or leaking flammable material or causing any harm to health or causing any harm to the validity of road for traffic or having a cargo with any material that is harmful to the street or constitutes any danger to its users or does not have its cargo wrapped, packaged and covered compactly and safely.

If the driver would commit the same violation twice within three months since the date of committing the first violation, the fine will be doubled.

If the driver would commit the same violation for a third time within six months of the date of committing the second violation, the same punishment mentioned in the previous paragraph will be applied with the driving license being withdrawn for one year.

Article (74):

Without violating any other stricter punishment in any other law, a fine not less than 500 pounds and not more that 1,000 pounds will be handed down to anybody who would commit the following acts:

1-    Failure to be committed to driving on the right side of the two-way road or who would drive in the opposite direction.

2-    Violating the rules of articles (7,67,68,69) of this law.

3-    Failure on part of the driver to follow the traffic signs and the directives of traffic policemen regulating movement on the street.

4-    Violating, in the case of trucks, the preconditions of the cargo weight, height, width and length.

In all cases, the fine will be doubled if the same violation is committed again within six months since the date of issuing a final court ruling.

Article (74) bis (2):

Anybody who drives a vehicle without a driving license will be punished with a prison term which is not more than six months and a fine not less than 1,000 pounds and not more than 2,000 pounds or any of these two punishments.

Article (76):

Without violating measures mentioned in this law or any other stricter punishment mentioned in any other law, anybody who drives a vehicle under the influence of alcoholic or drugs will be punished with a prison term that is not less than three months and not more than one year with a fine not less than 1,000 pounds and not more than 3,000 pounds or any of the two punishments. The punishment is doubled on repeating the same violation within one year of the date of issuing a final court ruling and the punishment of imprisonment and the fine which is not less than 1,000 pounds and not more than 3,000 pounds will be applied in the case of causing a traffic accident that would lead to the death or injury of somebody.

Article Two

The new articles and items Nos. (32, 42, 64) bis, item (11) of article (74) bis, article (74) bis (4), article (74) bis (5) will be added to the traffic law in question with the following texts:

Article (32):

The vehicle license and the driving license will be cancelled if the vehicle is used in a purpose other than that mentioned in its license. Another vehicle license or a driving license can not be obtained before 30 days since the date of discovering the violation.

In case of committing the same act again within six months since the date of committing it in the first time, the vehicle license and the driving license are cancelled for a period of time not more than three months. If the same act is committed for a third time within one year since the date of committing the same act for the first time, the vehicle license and the driving license are cancelled for six months.

This is not applied to the owner of the vehicle unless he would have approved moving the car, while knowing beforehand, that it is used in a purpose other than that mentioned in its license.

Article (42):

Any speed transport vehicle is banned from moving on street without having a valid license.

Also, the vehicle is banned from moving on the street during the period of withdrawing the license, suspending its validity or canceling it.

Article (64) bis:

Without violating rules of articles (28) and (64) of this law, a decision by the prime minister could be issued for regulating, setting or banning the movement of certain types of vehicles in certain places and at certain times.

Article (74) bis- item 11:

(11) Adding any stickers, drawings or any writing or symbols or any other data barring those allowed for by the law and regulations on the body of the vehicle or any part of it or on its number plate.

Article (74) bis (4):

Anybody who would drive a vehicle without a driving license or anybody who violates the rules of article (42) of this law will be punished with a prison term not more than six months and a fine not less than 1,000 pounds and not more than 2,000 pounds or any of the two punishments. In case the violation is repeated within one year, the punishment will be doubled.

Article (74) bis (5):

Anybody who would drive a vehicle in violation of rules of article (64) of this law will be punished with a fine not less than 1,000 pounds and not more than 3,000 pounds.

Article Three

This decision having the force of law is published in the official gazette and be put into force as of the second day of its publication.
